Introduction
Good afternoon, Escondido. I’m Brenda Ramirez with Channel 7 News. Today we’re joined by local probate attorney Steve Bliss of Escondido Probate Law. Mr. Bliss specializes in helping families navigate the often-complex world of estate planning and probate.
Steve, can you tell us a little about why probate is necessary and what steps are involved?
Probate is a legal process that occurs after someone passes away. It’s used to validate their will (if they had one) and distribute their assets to their heirs. Not every estate requires probate. Ordinarily, if the value of the estate is below a certain threshold – currently $184,500 in California – it may be possible to avoid probate altogether.
There are several key steps involved in the probate process, but one crucial stage is ‘Marshaling the Estate Assets.’ This step involves identifying and inventorying all of the deceased person’s assets. Consequently, this could include bank accounts, real estate, vehicles, personal belongings, investments, and any other property they owned.
It’s important to be thorough during this stage as any overlooked assets can lead to complications later on. For example, a forgotten retirement account or a piece of valuable jewelry could create discrepancies in the final distribution. We meticulously document everything, using forms like the DE-160 and DE-161 to ensure accuracy.
Moreover, during this stage, we also identify any debts or outstanding liabilities that the estate is responsible for paying. This ensures a smooth process when it comes time to distribute assets to beneficiaries.
While most clients approach this step with diligence and transparency, I remember one case where a family member had hidden a significant sum of cash. This caused delays and disagreements among the heirs. It underscored the importance of open communication and honesty during the probate process.
How common are situations like that?
Thankfully, cases involving hidden assets are relatively rare. According to the American Bar Association, approximately 90% of estates go through probate without any major complications. Nevertheless, it’s crucial to be prepared for the unexpected and work with an experienced attorney who can guide you through every step.
What advice would you give to someone considering estate planning?
Don’t wait until it’s too late. Creating a will or trust is one of the most important things you can do to protect your loved ones and ensure your wishes are carried out. Contact Escondido Probate Law today for a free consultation and let us help you create a plan that meets your unique needs.
