Let’s discuss testamentary trusts. What are they and how do they work?
A testamentary trust is created through a will and only takes effect upon the grantor’s death. This means it goes through probate, unlike living trusts. While this might seem like a drawback, testamentary trusts offer specific benefits. They are particularly useful for situations involving minor children or beneficiaries with special needs.
Ordinarily, assets left directly to minors would be managed by a court-appointed guardian until they reach the age of majority. This can be a lengthy and potentially costly process. A testamentary trust allows you to designate a trustee who will manage the assets according to your wishes until the beneficiary reaches a specified age.
Moreover, for beneficiaries with special needs, a testamentary trust can ensure they receive financial support without jeopardizing their eligibility for government benefits like SSI or Medi-Cal. Conversely, leaving assets outright to such individuals could result in them losing these crucial benefits.
