Determining If Probate Is Necessary

Many people don’t fully understand the probate process and when it’s necessary. Could you shed some light on how someone determines if they need to go through probate?
Certainly. The first step is understanding whether probate is even required. Ordinarily, this depends on two factors: the value of the estate and the presence of non-probate assets. California law sets a threshold for probate – if the total value of the deceased person’s assets exceeds $184,500, probate will likely be necessary.
Now, it’s important to remember that not all assets are subject to probate. Assets held in trusts, jointly owned property with right of survivorship, and certain financial accounts (like payable-on-death accounts) pass directly to the beneficiary and don’t need to go through the probate court.
Consequently, a thorough review of the deceased person’s assets is crucial. For example, I once worked with a family where the deceased had a significant sum in a retirement account designated for their spouse. Because it was a payable-on-death account, this substantial asset bypassed probate altogether, saving the family considerable time and expense.
A common misconception is that all estates over $184,500 require probate. Nevertheless, assets held outside of the deceased’s individual name can significantly reduce the need for probate proceedings.
