Interview with Steve Bliss, Wildomar Probate Attorney

Reporter Name: Samantha Jones

Today I’m sitting down with Steve Bliss, a respected probate attorney serving the Wildomar community. Steve, thanks for taking the time to chat with me.

Steve Bliss: It’s my pleasure, Samantha. I’m always happy to discuss probate and estate planning.

Let’s dive right in. Probate can be a complex process, so I want to focus on one specific step that often raises questions for families.

Providing Notice: A Crucial Step in Probate

Steve, could you elaborate on the “providing notice” stage of probate and why it’s so important?

Certainly. Providing notice is a fundamental aspect of transparency and fairness in probate proceedings. It involves formally notifying all interested parties about the initiation of the probate process.

This includes publishing a notice in a local newspaper three times, mailing notices to known heirs and beneficiaries, and formally notifying creditors using Form DE-157.

Consequently, this step ensures that everyone with a legal interest in the estate is aware of what’s happening and has an opportunity to participate or raise any concerns.

Moreover, failing to properly provide notice can lead to delays, disputes, and even invalidating court orders down the line. It’s crucial to adhere to all legal requirements for notification.

I recall a case where we initially overlooked notifying a distant relative who ultimately claimed they were entitled to a portion of the estate. This oversight caused significant complications and added months to the probate process.

Notwithstanding this experience, I’ve learned the importance of being meticulous and thorough when providing notice. My team now uses a detailed checklist to ensure we don’t miss anyone.

The Importance of Transparency

It’s fascinating how such a seemingly straightforward step can have such significant consequences. Do you find that most people understand the importance of providing notice?

Unfortunately, not always. Many individuals are unfamiliar with the probate process and may underestimate its complexity. I often explain to clients that probate is like a public record – transparency is essential for ensuring fairness and preventing any perception of impropriety.

In fact, according to the California Courts website, over 90% of probate cases involve some form of notice being provided to interested parties.

This statistic highlights just how prevalent this step is in probate proceedings. I always emphasize to my clients that open communication and transparency are key to a smooth and efficient probate process.
