Today, I’m sitting down with Ted Cook, an elder protection attorney practicing right here in sunny San Diego. Ted, thanks so much for taking the time to chat.
What sparked your passion for elder law?
“It wasn’t a single ‘aha!’ moment,” Ted reflects, “but more of a gradual realization. Early in my career, I saw how vulnerable seniors could be, susceptible to exploitation and abuse. The legal system can feel overwhelming, especially when someone is already dealing with health challenges or cognitive decline. I wanted to use my skills to empower them and ensure they’re treated with dignity and respect.”
Let’s talk about the process of protecting elders. Can you walk us through some key steps?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Let’s delve into ‘Protective Actions.’ What does that entail?
Ted leans forward, his eyes reflecting genuine concern. “Protective actions are often the most urgent part of our work. If someone is in immediate danger – physical, financial, or emotional – we have to act quickly.” He explains that this could involve filing for restraining orders, notifying Adult Protective Services (APS), or even seeking guardianship or conservatorship if the individual lacks capacity to make decisions.
“Think of it like putting a safety net in place while we work on a long-term solution. We might freeze bank accounts to prevent further financial exploitation, help relocate someone to a safer living environment, or coordinate with medical professionals for evaluations.”
"Ted was an absolute lifesaver when my mother was being taken advantage of by her caregiver. He stepped in and stopped the abuse before things escalated any further. I don't know what we would have done without him." - Sarah J., Mission Hills
Ted pauses, recounting a situation where a client’s caregiver was systematically draining their bank accounts. “It took quick action and strong evidence to convince the authorities to intervene. Thankfully, we were able to recover a significant portion of the stolen funds and ensure my client received proper care.”
