Probate Process Insight with Steve Bliss

Today we’re joined by Steve Bliss, a respected probate attorney serving the Moreno Valley community. Steve, thanks for taking the time to speak with us.

Discussing the Importance of Providing Notice in Probate

Steve, can you walk us through one of the key steps involved in the probate process and highlight any potential challenges?

Absolutely. One crucial step is providing notice to all interested parties. This includes publishing a notice in a local newspaper three times, mailing notices to heirs and beneficiaries, and notifying known creditors using Form DE-157.

The purpose of this step is transparency. Everyone who has a legal interest in the estate needs to be informed about the probate proceedings. It allows them to come forward with any claims or objections they may have.

Nevertheless, locating heirs and beneficiaries can sometimes prove challenging, especially when family relationships are strained or contact information is outdated. Consequently, we often need to conduct thorough genealogical research to ensure everyone receives proper notification.

Moreover, I recall a case where an heir resided overseas and had not been in contact with the family for years. Tracking them down required international cooperation and a significant amount of detective work. Ultimately, we were successful in locating them, which allowed them to participate in the probate process fairly.

Providing notice is essential for ensuring a smooth and legally sound probate process. It protects the rights of all parties involved and helps prevent future disputes.
